It
is possible for you to deal with your divorce yourself. This
can be difficult and stressful. We can give you help and guidance
and protect your position.
Finance
is a major concern for people who separate. We can advise
on your entitlement and obligation. If agreement is possible
we can ensure that documentation is in place to reflect the
agreement. If agreement proves impossible then we can take
the matter to court for you. The court will look at factors
such as the needs and obligations of each spouse, the needs
of the children and the resources which the parties have available.
The court will then decide a reasonable level of financial
provision.
The
most important people in any dispute are the children. Whether
married or not you may need advice about arrangements for
your children if you separate. If you cannot agree on arrangements
for the children then one or both parents can apply to the
court for a residence order and also ask the court to determine
how long the child should spend with each parent. If the court
is asked to decide, the decision will be taken with the interests
of the child being paramount. We can give help and advice
in resolving problems and implementing the correct court procedure.
It
is always preferable to agree how parental responsibility
will be allocated or shared. If agreement proves impossible
then the issue can be referred to the court. The team not
only deals with those who are or have been married but also
with those who are cohabiting or have been cohabiting. We
are able to advise what remedies are available on separation
at the end of an unmarried relationship and we can also advise
upon the terms of a co-habitation agreement which can address
many of the issues and avoid acrimony if the worst happens.
Cost
is always a consideration. We will provide you with an estimate
of the likely costs at the outset of every matter and will
update you regularly as things progress. We also have various
facilities for payment to help alleviate the worry about cost.
